1. About these terms#
These terms apply when you use the Wattly website (wattly.co.uk) or the Wattly app for iPhone and Android (together, “Wattly”). Wattly is run by Wattly Ltd, a company registered in England and Wales (“we”, “us”).
By creating an account or using Wattly you agree to these terms. Please also read our Privacy Policy, which explains how we use your data. Hosts must also follow any host rules shown in the app when listing a charger.
If you are a consumer, you have legal rights that these terms don't affect. For advice, contact Citizens Advice.
2. Who can use Wattly#
- You must be 18 or over and live in the UK.
- Drivers must have the right to use the vehicle they charge and a valid payment method.
- Hosts must be entitled to offer the charger and the parking space they list (see section 6).
- You can't use Wattly if we have previously closed your account for breaking these terms, unless we agree.
3. Your account#
- Give accurate information and keep it up to date.
- Keep your sign-in details secret. You're responsible for what happens on your account unless someone else used it without your fault.
- Tell us straight away at hello@wattly.co.uk if you think someone else has accessed your account.
- One person, one account. Accounts can't be transferred.
- If you registered on our website before the app launched, the same account works in the app.
4. Wattly's role#
Wattly is a platform that connects drivers with hosts. We provide the app, the booking system and payment handling (through Stripe), and we help when things go wrong.
- We are not the owner, installer or operator of any host's charger, and we don't inspect chargers.
- We are not an energy supplier. The electricity comes from the host's own supply.
- When a driver books a charger, the agreement to use the charger and the space is between the driver and the host. Our agreement with each of you is these terms.
- The public charge point map shows information from third-party sources. We can't guarantee that public chargers are available, working or priced as shown.
This doesn't reduce our own responsibility to run Wattly with reasonable care and skill (see section 11).
5. If you're a driver#
When you book and use a host's charger, you must:
- check that your vehicle and connector are compatible with the charger before you book, and bring your own suitable cable if the listing says the charger is “untethered”
- arrive and leave within your booked time slot. If you stay longer than your booking (overstay), you may have to pay extra charges or fees as shown in the app at booking
- follow the host's access instructions and house rules, use only the space and equipment you booked, and treat the host's property and neighbours with respect
- use the charger safely and as intended, and stop and report a problem in the app if anything looks damaged or unsafe
- keep your vehicle roadworthy and insured
- pay for any damage you cause through your own fault or carelessness
6. If you're a host#
When you list a charger, you confirm and agree that:
- Safe installation: the charger was installed by a qualified, competent installer, meets current UK wiring regulations and standards, and is properly maintained. You'll stop taking bookings if it becomes faulty or unsafe.
- Permissions: you have every permission you need to let other people use the charger and parking space. This may include your landlord or freeholder, your mortgage lender, any management company, and planning or parking rules.
- Insurance: you have told your home and other relevant insurers that you're sharing your charger with paying members of the public, and you have suitable cover, including public liability. Wattly doesn't provide insurance for hosts or drivers.
- Energy supply: you've checked that your electricity supply contract and tariff allow this use.
- Accurate listings: your listing, including location, photos, connector type, power, availability, access instructions and price, is accurate and kept up to date. You'll honour bookings you accept.
- Pricing: you set your own prices, which must be shown clearly in your listing. You must not ask drivers for extra payments outside Wattly.
- Tax: you are responsible for any tax on your earnings, such as income tax, and for VAT if you're registered. Where the law requires, we will share details of your earnings with HMRC under the digital platform reporting rules.
- Payouts: to receive money you must set up and keep a Stripe Connect account and accept Stripe's terms (see section 8).
- Laws: you comply with all laws that apply to you as a host, including data protection law for any driver details you see.
If you host as a business, you're responsible for meeting the rules that apply to businesses, and section 11 explains how our liability to business users differs.
7. Bookings, cancellations and refunds#
- Making a booking: a booking is confirmed when the app tells you so. The price, time slot, cancellation terms and any fees are shown in the app before you confirm.
- Payment holds: when you book, we may place a temporary hold on your card for up to the maximum price shown. You are then charged the final amount for the session, as shown in the app at booking. Any unused part of the hold is released by your bank, which can take a few days.
- Cancellations by drivers: you can cancel in the app. Whether you get a full or partial refund depends on how close to the start time you cancel, under the cancellation terms shown in the app at booking.
- Cancellations by hosts: if a host cancels, the driver gets a full refund. Hosts who cancel repeatedly may have their listings paused.
- Problems on arrival: if the charger doesn't work or you can't get access through no fault of your own, report it in the app before starting the session. Where the problem is confirmed, you'll get a full refund.
- Disputes: if something goes wrong during or after a session, raise it in the app within the time shown there. We will look at the information from both sides and decide on any refund fairly. This doesn't affect your legal rights.
- Statutory cancellation rights: consumers usually have 14 days to cancel a contract made online. By booking a session that starts within that period, you ask for the service to begin straight away. If you cancel before the session, our in-app cancellation terms apply, and these won't give you less than the law does.
- Refunds go back to the payment method you used.
8. Prices, fees and payments#
- Prices: hosts set their prices. The total you'll pay, including any Wattly fees, is shown before you confirm a booking.
- Service fees: Wattly may charge drivers and/or hosts a service fee for using the platform. Any fee is shown in the app before you book, or before you publish or accept a booking as a host. We won't add a fee you weren't shown.
- Payments: drivers pay through Stripe, our payment provider, inside Wattly. Card details are handled by Stripe, not us. You agree to Stripe's terms for payments.
- Host payouts: payouts are made through Stripe Connect to the bank account in your Stripe account, after taking off any Wattly fees, refunds or amounts owed. Payout timing is shown in the app. Stripe has to verify your identity before it can pay you. You agree to the Stripe Connected Account Agreement.
- Held payments: we may delay a payout while we look into a dispute, a chargeback or suspected fraud.
- Off-platform payment: you must not pay or accept payment outside Wattly for a booking made through Wattly. Our protections and refunds only apply to payments made in Wattly.
9. Reviews and content#
- After a session, drivers and hosts can review each other. Reviews must be honest, based on a real booking, and not offensive, discriminatory or defamatory.
- You must not write fake reviews, review your own listing, or offer or accept anything in return for a review. We don't pay for or buy reviews.
- We may remove reviews or content that break these terms or the law, and we will publish reviews whether they're positive or negative.
- You own the content you upload, such as listing photos. You give us a non-exclusive, royalty-free licence to use, display and adapt it to run and promote Wattly. This licence lasts while the content is on Wattly and for a reasonable time afterwards.
- Wattly's name, logo, app, website and other content belong to us or our licensors. Map data is © OpenStreetMap contributors.
10. Things you must not do#
You must not:
- break the law, or use Wattly for fraud, money laundering or to harm anyone
- harass, threaten or discriminate against other members or their neighbours
- list a charger or space you don't have the right to share, or create fake listings or bookings
- tamper with, damage or modify a host's charger or property
- copy, scrape or harvest data from Wattly, including the charge point map, by automated means
- try to get around our security, rate limits or payment system, or reverse-engineer the app except as the law allows
- upload viruses or anything harmful, or interfere with how Wattly works
- use another person's account, or have more than one account
11. Our responsibility to you#
What we are responsible for
We will provide Wattly with reasonable care and skill. If we fail to follow these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill. Loss is foreseeable if it was obvious it would happen, or if we both knew it might happen when you agreed to these terms.
What we never exclude
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded under the law of England and Wales, including your rights under the Consumer Rights Act 2015.
What we are not responsible for
- The condition, safety, installation or performance of a host's charger or property, or what a driver or host does, except where our own negligence or breach of these terms caused the loss.
- Loss that wasn't foreseeable, or that was caused by events outside our reasonable control.
- For consumers: business losses, such as lost profit or business interruption. Wattly is provided for private use.
- For hosts or other users acting in the course of a business: indirect or consequential loss, and loss of profit, revenue or goodwill. Our total liability to a business user in any 12 months is limited to the Wattly service fees that user paid in that period.
Drivers and hosts are responsible to each other for loss or damage they cause through their own fault.
12. The app and app stores#
We give you a personal, non-transferable, non-exclusive licence to use the Wattly app on devices you own or control, under these terms. If you downloaded the app from Apple's App Store, the following also applies:
- These terms are between you and Wattly Ltd only, not Apple. Wattly, not Apple, is solely responsible for the app and its content.
- Your licence is limited to using the app on Apple-branded products you own or control, as allowed by the Usage Rules in Apple's Media Services Terms and Conditions.
- Wattly, not Apple, is solely responsible for maintaining and supporting the app. Apple has no obligation to provide any maintenance or support.
- If the app fails to meet any warranty that applies, you may tell Apple and Apple will refund the purchase price (if any). To the maximum extent the law allows, Apple has no other warranty obligation for the app. Any other claims, losses or costs from a failure to meet a warranty are Wattly's responsibility, as set out in these terms.
- Wattly, not Apple, is responsible for dealing with any claims about the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
- If anyone claims the app or your use of it infringes their intellectual property rights, Wattly, not Apple, is solely responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not in a country subject to a US Government embargo or designated by the US Government as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
- You must comply with any third-party terms that apply when using the app, such as your mobile network agreement.
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.
- Questions, complaints or claims about the app should go to Wattly Ltd at hello@wattly.co.uk.
If you downloaded the app from Google Play, Google is not a party to these terms and isn't responsible for the app. Google Play's own terms apply to the download.
We may release updates to the app. Some may be needed for the app to keep working or to stay secure.
13. Suspension and closing accounts#
- You can close your account at any time in the app (Settings → Privacy & data settings → Delete my account) or by emailing us. Bookings you've already made, and money owed either way, are still dealt with under these terms.
- We may suspend or close your account, remove listings or cancel bookings if you seriously or repeatedly break these terms, if we reasonably suspect fraud or a safety risk, or if the law requires it. Where it's safe and lawful, we will tell you why and give you a chance to respond.
- We may close Wattly or stop a feature. If we do, we will give you reasonable notice and refund anything you've paid for that hasn't been provided.
14. Changes to Wattly and these terms#
We may change these terms, for example when the law changes, to reflect how Wattly works, or to add features. If a change materially affects you, we will tell you in advance by email or in the app. If you don't agree, you can close your account before the change takes effect. Bookings already confirmed stay under the terms that applied when you made them.
15. Complaints, governing law and disputes#
If you have a complaint, email hello@wattly.co.uk and we will try to resolve it quickly and fairly.
These terms are governed by the law of England and Wales. The courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
16. General#
- If a court decides that part of these terms is invalid, the rest still applies.
- If we don't enforce a right straight away, we can still enforce it later.
- We may transfer our rights and obligations under these terms to another organisation, and we will make sure this doesn't reduce your rights. You may not transfer yours without our written agreement.
- Apart from Apple (section 12), no one else has a right to enforce these terms.
